• The judge has given the plaintiffs two weeks to file a second amended complaint

A group of customers is attempting to sue Compass Mining for over $2 million for failure to return their Bitcoin machines after cutting ties with a Russian hosting company. The customers allege that Compass Mining did not disclose to Bit River that it was only the “middleman”, not the owner of the machines.

The complaint was filed with the United States District Court of Southern Florida on Jan. 17 and it states that Compass Mining terminated its “relationships and dealings with Bit River” in April 2022 due to the sanctions imposed by Executive Order 14024. The complaint also claims that the Bitcoin machines hosted at the Russian facility were never returned to customers.

The complaint argues that Compass Mining’s explanation that the mining machines’ return would violate Executive Order 14024 was “false” and said that Compass has “both the right and obligation to effect the return of its customers’ miners.” It also alleges that Compass was unhelpful in helping customers retrieve their stranded machines.

The plaintiffs argued that the lack of disclosure by Compass Mining is a breach of contract and requested the court to order Compass to return the machines, as well as to award them the price of the machines, including the associated costs, as well as damages for their loss of business.

In response to the lawsuit, the judge gave the plaintiffs two weeks to file a second amended complaint. If the plaintiffs are successful in filing an amended complaint, the case will proceed and the customers will have a chance to reclaim their Bitcoin machines. If the amended complaint is not successful, the case will be dismissed and the customers will have to seek alternative methods for retrieving their machines.
